JAKARTA (IndependensI.com) – Komisi Pemberantasan Korupsi (KPK) menahan Bupati Batubara OK Arya Zulkarnain. Dia ditahan bersama empat tersangka lainnya dalam kasus dugaan tindak pidana korupsi suap terkait dengan pekerjaan pembangunan infrastruktur di Kabupaten Batubara Tahun Anggaran 2017.
Menurut Jubir KPK Febri Diansyah, KPK menahan kelima tersangka tersebut selama 20 hari ke depan untuk kepentingan penyidikan. “KPK menahan kelima tersangka untuk kepentingan penyidikan,” kata Juru Bicara KPK Febri Diansyah di Jakarta, Kamis (14/9) malam.
Febri menjelaskan, untuk para tersangka diduga sebagai pihak penerima, yaitu OK Arya Zulkarnain (OKA) ditahan di Polres Jakarta Timur, Kepala Dinas PUPR Pemkab Batubara Helman Herdady (HH) ditahan di Rutan Salemba Jakarta Pusat, dan pemilik dealer mobil Sujendi Tarsono (STR) ditahan di Rutan Kelas I Jakarta Timur Cabang KPK C1.
Kemudian untuk para tersangka diduga sebagai pihak pemberi, yakni dua orang kontraktor masing-masing Maringan Situmorang (MAS) ditahan di Rutan Cipinang Jakarta Timur dan Syaiful Azhar (SAZ) ditahan di Rutan Polres Jakarta Pusat.
Dalam OTT itu, total KPK mengamankan uang tunai senilai Rp346 juta. Uang tersebut diduga bagian dari fee proyek senilai total Rp4,4 miliar yang diduga diterima oleh Bupati Batubara melalui para perantara terkait beberapa pekerjaan pembangunan infrastruktur di Kabupaten Batubara Tahun Anggaran 2017.
Dari pemeriksaan penyidik, dari total fee Rp4,4 miliar terdapat sisa fee Rp1,6 miliar yang dikuasai oleh tersangka STR, pemilik dealer mobil.
“Jadi, semua dana disetorkan ke STR. Pada saat tertentu OKA butuh nanti diberikan oleh STR. Itu pada OTT tanggal 13 September 2017 modusnya begitu. Jadi, OKA tidak megang uangnya sendiri, yang megang STR,” kata Wakil Ketua KPK Basaria Panjaitan saat konferensi di gedung KPK, Jakarta, Kamis (14/9).
Pertama, dari kontraktor MAS diduga pemberian fee sebesar Rp4 miliar terkait dua proyek, yaitu pembangunan Jembatan Sentang senilai Rp32 miliar yang dimenangkan oleh PT GMJ dan proyek pembangunan Jembatan Sei Magung senilai Rp12 miliar yang dimenangkan oleh PT T.
Barang bukti Rp346 juta dalam OTT ini diduga merupakan bagian dari fee terkait dua proyek itu. Kedua, dari kontraktor SAZ diduga pemberian fee sebesar Rp400 juta terkait dengan proyek betonisasi jalan Kecamatan Talawi senilai Rp3,2 miliar.
Sebagai pihak yang diduga pemberi, MAS dan SAZ disangkakan melanggar Pasal 5 ayat 1 huruf atau huruf b atau pasal 13 UU No. 31 Tahun 1999 sebagaimana telah diubah dengan UU No. 20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi.
Pasal itu yang mengatur mengenai memberi sesuatu kepada pegawai negeri atau penyelenggara negara dengan maksud supaya pegawai negeri atau penyelenggara negara tersebut berbuat atau tidak berbuat sesuatu dalam jabatannya, yang bertentangan dengan kewajibannya.
Ancaman hukuman minimal 1 tahun penjara dan maksimal 5 tahun penjara dan denda paling sedikit Rp50 juta dan paling banyak Rp250 juta.
Sedangkan sebagai pihak yang diduga penerima, OKA, STR, dan HH disangkakan melanggar Pasal 12 huruf a atau pasal 12 huruf b atau pasal 11 UU No 31 Tahun 1999 yang diubah dengan UU No 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korups jo pasal 55 ayat (1) ke-1 jo pasal 65 KUHP.
